Kenya Law The Kenyan Constitution provides for an independent judiciary. The President has extensive powers over appointments, including those of the Attorney General, the Chief Justice, and Appeal and High Court judges. The President also can dismiss judges and the Attorney General following recommendations by a tribunal appointed by the President. Judges have life a life tenure.
The court system consists of a Court of Appeals, a High Court, and two levels of magistrate courts, where most criminal and civil cases are heard. The Chief Justice is a member of the Court of Appeals as well as the High Court. Military personnel are tried by military courts-martial, and verdicts may be appealed through military court channels. There are no customary or traditional courts in the country. Kenyans have a choice between national
and customary law when they enter into marriage. The courts decide which
